01Acceptance
These terms govern your use of the Brocha app and mibrocha.com (“Brocha”), a service run by David Levi, an individual based in Little Elm, Texas, United States (support@mibrocha.com). By using Brocha you accept these terms and the Privacy Policy. If you don’t agree, please don’t use Brocha.
02What Brocha is
Brocha connects clients with independent makeup artists and hair stylists (“artists”). Artists show their work, prices and free dates; clients request appointments and talk to them in the chat.
Brocha does not provide makeup or hair services, does not employ artists, and does not receive or hold payments between clients and artists. Each artist is an independent professional and solely responsible for the service she offers.
03Who can use Brocha
- You must be 18 or older. If the appointment is for a minor (for example, a quinceañera), her parent or guardian requests it.
- You must give accurate information and keep it up to date.
- You are responsible for your account and your private links; don’t share them.
04Appointments, prices and payments
- The price you see on Brocha is an estimate. The artist confirms it with her quote.
- Deposits and balances are paid directly to the artist using the methods she lists (for example Zelle, Nequi, bank transfer or cash). Brocha charges no commission on appointments, to clients or to artists.
- Cancellations, changes and refunds follow each artist’s policy, which must be clear before you pay. Brocha can’t refund payments it never received.
- If the artist publishes her policies on Brocha (arrival, grace period, cancellation, deposit, no-shows and others), you see them on her profile and accept them when you request the appointment; we keep a dated copy. They are an agreement between you and the artist: Brocha doesn’t write them, enforce them or handle that money. They can’t take away rights the law gives you.
- If the artist can’t take your request or cancels your appointment, we show you the reason she picks.
- If something goes wrong with an appointment, talk to the artist in the chat first. If it isn’t solved, write to us: we can help mediate and, where the law requires it, give the artist’s identification details to the client so she can file a complaint, or to the authorities.
05If you are an artist
- You give accurate information and keep it current: services, prices, policies and availability.
- You only publish photos of your own work that you have the rights to, with permission from the people in them and, for a minor, from her parent or guardian.
- You follow the laws that apply to you (taxes, licenses, hygiene and consumer protection) and honor your quotes and policies.
- You use your clients’ data only to serve them and you are responsible for it under the law.
- Your policies must be clear, fair and lawful where you work; they can’t take away rights the law gives your clients. You are responsible for them and for how you apply them.
- If your form asks for photos or an ID, only ask when you need them for the appointment, and use them only to prepare for it and to know who you are meeting. Don’t copy, download, store outside Brocha or share them. Brocha deletes the ID automatically 7 days after the appointment.
- Your client sees the reason you pick when you decline or cancel an appointment. Be honest and respectful.
- We may ask for and verify your legal name, ID number, address and phone to comply with the law (in Colombia, article 53 of Law 1480 of 2011). We don’t publish them.
- Your profile may appear in the Brocha directory, on your link and in link previews when someone shares your link.
06Content and conduct: zero tolerance
You are responsible for what you post or send: profile, photos, messages, files and reviews. It is not allowed to:
- harass, threaten, insult or discriminate, or post hate speech;
- post sexual content or nudity, or anything that sexualizes minors;
- post violent or illegal content, or content that infringes someone else’s rights (for example, other people’s photos);
- spam, scam, impersonate others or write fake reviews;
- share other people’s personal data without permission;
- try to break Brocha’s security or use it with automated tools.
You can report content and block another person in the app, or write to support@mibrocha.com. We review reports as quickly as we can, usually within 24 hours, and we may remove content and suspend or close accounts that break these rules, without notice when it’s serious.
07Reviews and badges
Only clients with a real appointment can leave a review. Reviews must be honest and about your own experience. We don’t remove reviews for being negative; we do remove ones that break these rules. The PRO badge is earned with completed appointments and good reviews; it can’t be bought.
08Your content
Your content stays yours. You give us a free, worldwide, non-exclusive permission to store, show and adapt it (for example, resizing a photo) only to run Brocha and show your profile. If we want to use your work on our social media or in ads, we’ll ask you separately. The permission ends when you delete the content or your account.
09Brocha Plus
Brocha Plus is an optional subscription for artists. It includes: your request form (photos, questions and ID), your prep checklist for clients, Money (income, expenses and profit), branded PDF quotes and alerts for unpaid deposits and balances. Everything else in Brocha stays free with no limits (including your policies and decline reasons), and the commission stays at 0%. If Plus ends, we keep your form and checklist, but clients stop seeing them until you turn it back on. Plus doesn’t buy the PRO badge or better placement: those can only be earned.
- Price and terms: monthly or yearly. The price, in your currency and with any taxes your store applies, is shown before you buy.
- Free trial: if it’s your first subscription on that store account, you may get 1 month free. Unless you cancel at least 24 hours before the trial ends, the plan you chose starts and is charged.
- Billing and renewal: Apple (App Store) or Google (Google Play) charges your store account. It renews automatically for the same period unless you cancel at least 24 hours before the period ends.
- Cancelling: in your store’s subscription settings (in the app: Studio → Brocha Plus → Manage subscription). You keep Plus until the end of the period you already paid for.
- Refunds: decided by Apple or Google under their rules; Brocha can’t refund charges made by the store. None of this limits the rights your country’s consumer law gives you; if you think a right of withdrawal applies to you, write to us.
- If you delete your Brocha account, the subscription doesn’t cancel by itself: cancel it in your store.
- Price changes: we’ll let you know through the store before they apply, following its rules.
10Brocha’s property
The Brocha brand, design and software belong to us. You may not copy them, modify them or use them to build a similar service.
11Liability
Brocha is provided “as is”. We do our best to keep it working well, but we don’t promise it will always be available or error-free.
To the extent the law allows, Brocha is not responsible for the service each artist provides (results, allergic reactions, delays or no-shows), for payments between client and artist, or for indirect damages. If we are liable for anything, our total liability is limited to what you paid us in the last 12 months or US$100, whichever is greater.
Nothing here limits the rights your country’s consumer protection law gives you.
12Closing your account
You can delete your account anytime. We may suspend or close accounts that break these terms or the law.
13Governing law
These terms are governed by the laws of the State of Texas and applicable United States federal law, without prejudice to the consumer and data protection laws of your country of residence, which always apply in your favor.
14Changes
We’ll let you know before a change applies. If the change is important, we’ll ask you to accept the terms again.
